Terms and conditions
General
These general terms and conditions apply to all training courses that Product Facilitator offers and carries out. Deviating agreements must be agreed in writing and supplement these general terms and conditions.
Terms of payment
The invoice received by the client must be paid 30 days after invoice due date. If this condition is not met, the statutory interest will be charged.
Execution of the order
Product Facilitator will carry out the assignment with the best possible knowledge and skills. This obligation has the characteristics of a best efforts obligation. Achieving the desired result cannot be guaranteed.
Cancellation and early termination
Cancellation is assessed on the date of the invoice. In case of cancellation between 4 and 2 weeks before the start of the training, 50% of the costs will be due. In case of cancellation within 14 days before the start of the training, the total costs are due. If participants do not show up for the training, this will be seen as a cancellation. It is then not possible to follow the training on another day. The client is not entitled to a refund if the training is stopped prematurely or prematurely by the participants.
Cancellation or change by Product Facilitator
Product Facilitator reserves the right to cancel a training without giving a reason. The costs that have already been charged will be credited. Product Facilitator is entitled to change a date or times of a training at any time.
Confidentiality
Product Facilitator is obliged to keep all information and data of the participants confidential. Product Facilitator will take all possible precautions in the context of the training to protect the interests of the participant.
Accountability/Integrity
Product Facilitator is liable for shortcomings in the implementation of the training, insofar as these are the result of failure to observe the care, expertise and craftsmanship that may be relied on in the implementation of the training. The liability for damage caused by the shortcomings is limited to the amount of the costs that Product Facilitator has received. Liability with regard to trading loss and/or indirect damage, including consequential damage, lost profit, lost savings and damage due to business interruption is expressly excluded. Product Facilitator accepts no liability for any costs of participants or their organization, which could be caused by a cancellation of a training. Product Facilitator is not liable for any damage that may be caused to property of participants during the training. The participants must take care of their belongings at all times. The participant is expected to follow safety instructions and standards.
Complaints
Complaints about the training must be reported in writing by the client to Product Facilitator within 8 days after discovery. The notice of default must contain as detailed a description as possible of the shortcoming, so that Product Facilitator is able to respond adequately. If a complaint is well-founded, Product Facilitator can decide whether or not to reimburse the costs in part.
Applicable law
Only Dutch law applies to all agreements to which these General Terms and Conditions for services relate in whole or in part.
Dispute settlement
The parties will only appeal to the courts after they have made every effort to settle a dispute in mutual consultation.
Final provision
In those cases not provided for in these General Terms and Conditions for services, Dutch law also applies.
